Terms & Conditions

1. Applicability

1.1 These terms and conditions apply to all offers, orders, and agreements of the seller. 1.2 By placing an order, the customer declares to have read and agreed to these terms. 1.3 The seller reserves the right to amend these terms. For existing agreements, the terms that were in force at the time of ordering remain applicable. 1.4 Deviating conditions are not accepted unless agreed upon in writing via email with the seller. 1.5 The seller guarantees that all delivered products comply with the agreement and meet the specifications stated in the offer.

2. Prices and Payment

2.1 All prices on the webshop are listed in euros and include VAT, unless stated otherwise. Any shipping costs are clearly displayed before completing the order. 2.2 The seller reserves the right to change prices at any time; for an order, the price valid at the time of ordering applies. 2.3 Payment must be made via the available payment methods on www.kussenwebshop.be. The order will only be processed after successful payment. 2.4 If a payment is refused or fails, the order is invalid and will not be executed.

3. Delivery

3.1 Products are delivered to the address provided by the customer. 3.2 Orders are generally shipped within 30 days. If delivery is delayed or a product appears to be unavailable, the customer will be informed within the same period. The customer may then cancel the order free of charge. 3.3 All stated delivery times are indicative. Exceeding these times does not entitle the customer to compensation. 3.4 The seller is not liable for delays caused by third parties, such as transport services. 3.5 Delivery is considered completed once the package has been offered once at the specified address or delivered to the selected pickup point. The carrier’s report serves as proof. 3.6 If a package is not collected or collected too late and is returned to the seller, the following costs are charged to the customer:

• original shipping costs (including when shipping was free)

• return shipping costs

• administrative and processing fees 3.7 Any refunds will be reduced by these costs. For reshipment, new shipping costs will be charged.

4. Right of Withdrawal / Returns

4.1 The consumer has the right to withdraw from an order within 14 days after receipt without giving any reason (excluding custom-made products). 4.2 The consumer must report the return in writing within 14 days after receipt. The product must then be returned within 14 days. 4.3 Returns must be sent back in their original condition and packaging. Used, damaged, or incomplete products will not be accepted. 4.4 The costs and risk of the return shipment are borne by the consumer. 4.5 After correct receipt, the purchase amount will be refunded within 14 days. 4.6 For volume discounts, the unit price will be recalculated based on the number of items the customer ultimately keeps.

5. Data Management / Privacy

5.1 Personal data is processed in accordance with GDPR legislation. 5.2 The seller does not share personal data with third parties unless necessary for the execution of the agreement (e.g., shipping). 5.3 For more information, the seller refers to the Privacy Policy and Cookie Policy on the website.

6. Warranty & Conformity for Consumers

6.1 The delivered products must comply with the agreement and meet reasonable expectations of quality and reliability. The dimensions and weights stated on the website are indicative. Given the nature of the products (textiles/filling materials), minor deviations in size (up to a tolerance of approximately +/- 2 cm) and weight (up to a tolerance of approximately +/- 50 grams) are possible and do not constitute grounds for complaints or termination of the agreement.

6.2 The customer must inspect products immediately upon receipt. Visible defects must be reported by email within 48 hours via info@kussenwebshop.be. 6.3 Returns are only possible in the case of a justified complaint and after prior notification. 6.4 Damage caused by incorrect, improper, or careless use is not covered by the statutory conformity guarantee.

7. Offers

7.1 All offers are non-binding unless explicitly stated otherwise. 7.2 After acceptance, the seller reserves the right to withdraw an offer within three working days. 7.3 Offers do not automatically apply to repeat orders. 7.4 Changes are only valid when agreed upon in writing.

8. Agreement

8.1 An agreement is only concluded after the seller has reviewed the order and deemed it feasible. 8.2 The seller reserves the right to refuse orders or accept them only with prepayment.

9. Images & Specifications

9.1 Images, colours, and dimensions on the website are indicative and may differ from reality. No rights can be derived from them.

10. Force Majeure

10.1 In the event of force majeure, the seller is not liable for failing to fulfil obligations. 10.2 Force majeure includes, among others: technical failures, supplier delays, strikes, transport issues, government measures, internet outages, and other circumstances beyond the seller’s control. 10.3 In case of force majeure, the agreement may be suspended or terminated without entitlement to compensation.

11. Liability

11.1 The seller is not liable for damage resulting from incorrect, improper, or careless use of the products. 11.2 The customer must always follow the usage and maintenance instructions to prevent damage or reduced lifespan.

12. Retention of Title

12.1 All delivered products remain the property of the seller until the customer has fulfilled all obligations, including full payment. 12.2 As long as ownership has not been transferred, the customer may not sell, pledge, or otherwise encumber the products.

13. Copyright

13.1 All texts, photos, designs, and other content on the website are protected by copyright. 13.2 Use, copying, or distribution without written permission is prohibited. 13.3 In case of unauthorized use, the seller reserves the right to take legal action.

14. Applicable Law & Disputes

14.1 All agreements are governed by Belgian law. 14.2 Disputes are handled via the European ODR platform or submitted to the competent courts of the district of Bruges, unless mandatory legislation provides otherwise.

15. Definitions

Webshop / Seller: Sweetee Textiles BV, BE0642809201, located at Hoge Hul 34, 8000 Bruges (Belgium), operating via www.kussenwebshop.be. Customer: The natural or legal person entering into a distance contract with the Seller, whether or not acting in the course of a profession or business. Consumer: The natural person not acting in the course of a profession or business who enters into a distance contract with the Seller. Products: Decorative cushions, pillows, duvets, pillowcases, and related items offered through the webshop. Right of Withdrawal: The consumer’s right to cancel the purchase within the statutory cooling-off period. Cooling-off Period: A period of 14 days after receipt of the product.
